GENERAL TERMS AND DIRECTIONS FOR TOURIST ARRANGEMENTS OF TRAVEL AGENCY “MIRJANA RASTOKE”
1. Arrangement contents
The organizer of Your travel guarantees implementation of the program according to the description of the arrangement that he organizes and that You have received. Contents of the arrangement will be realized completely by the organizer except in the cases of exceptional circumstances (war, riots, strikes, terrorist actions, sanitary disorders, natural disasters, interventions of competent authority, etc.)
2. Entries and payments
Entries for arrangements are received in travel agency “Mirjana”.
a) During the entries buyer pays 30% of the arrangements value, and the remaining 70% of the amount needs to be paid 15 days latest before travel start, except in the cases when for the individual travels special terms of payment are notable or when the time-limit till the start of the travel is shorter than 15 days.
b) For “reservations on inquiry” an advance is paid according to the price list of organizer in charge. The organizer will not accept entry of the reservation on inquiry without paid advance. If the traveler does not accept confirmed reservation that was made on his request, the organizer will withhold paid advance for reservation defrayment.
c) In case of paid and confirmed arrangement, every change of the date and the user of the travel is paid according to the price list of the services (and company rules)
3. Contents and price of the arrangement
The content of the arrangement makes that is the price of the arrangement includes everything that the organizer has set out in the arrangement program. Special services are services that are not included in the price thereby the traveler pays them separately.
These services need to be requested during entry and are additionally paid on the price of the arrangement. Facultative and special services that the traveler demands during the duration of the travel are paid to the tourist associate or the representative of the travel organizer in the currency of the state in which the service is provided. Price of the arrangements are issued in Croatian currency and are calculated according to the service prices in referent currencies at selling courses of the business bank of the organizer of the travel on specified day. In case of course change for more than 2 % agency holds the right to change the prices. Organizer holds the right to change the issued prices in case of changed prices of accommodation, meals, transport and other services that is in case of variation of value references of the currencies that are basis for calculation of the price of the arrangements. For the elevation of the arrangement prices up to 10% buyers consensus is not necessary (elevation is calculated on every part of payment). In case of price elevation higher than 10%, the buyer has the right to abjure from the travel without obligation on reparation.
4. Categorization and service description
Offered accommodation facilities, restaurants, means of transport, etc. are described according to the official categorization in time of program issue. Standards of accommodation, meals, services and other individual places and states are different and are not comparable. The information that the traveler receives on retail outlet does not bind the organizer highly apart from the information issued in travel program.
5. Program variation
Arrangement organizer has the right to change the program if exceptional circumstances appear which can not be foreseen, evaded or eliminated (see paragraph 1.) Arranged accommodation can be replaced only with accommodation in a facility of the same or higher category, and on organizers expense.
6. Travel documents
The traveler that entries for travel aboard must have valid personal documents, unless visa is necessary to enter an n exact country than the organizer will inform the traveler about necessary documents to procure the visa. Traveler collects the necessary documentations and delivers it to competent embassy. The organizer issues receipt (certificate) about made reservation, that traveler attaches to other documentation. The organizer does not guarantee for procurement and validity of the visa.
7. Organizers right on cancellation
Organizer can cancel the arrangement completely or partly if before or during its schedule exceptional circumstances appear that can not be avoided or averted, and they appeared in time of issuing and sale of the program, for the organizer would be reasonable grounds not to issue and receive entries for the arrangement. The organizer can also cancel the arrangement if an insufficient number of travelers anticipated for a specific arrangement entry. Organizer is in obligation to inform all buyers about cancellation at least 5 days before start of the arrangement, as well as to return all paid amount of the arrangement.
8. Travelers withdrawal from the travel
If the traveler cancels or aborts the travel, it has to do that in writing. The date of the written cancellation represents basis for calculation of cancel expenses that will be charged by the organizer, according to the following scale:

for cancellation up to 30 days before the travel organizer charges 5% of the arrangements price

for cancellation from 29 to 22 days before travel 20% of the arrangements price

for cancellation from 21 to 15 days before travel 30% of the arrangements price
-
for cancellation from 14 to 8 days before travel 50% of the arrangements price
-
for cancellation from 7 to 0 days before departure 80% of the arrangements price
-
after departure the total price of the arrangement , when real expenses incurred larger than those in quoted scale, travel organizer holds the right to charge really incurred expenses
Quoted expenses of cancellation also apply to changes of the date of the departure or accommodation facility, as well as on every other relevant change.
9. Obligations of the travel organizer
Organizer is obliged to attend about execution of the services as well as about selection of the service providers carefully as a good organizer, and to take care for rights and interests of the travelers according to good tourism manners. Organizer is obliged to issue the adequately documents for paid travel. Organizer excludes every responsibility in case of change and unperformed services caused by higher force (paragraph 1.), as well as regarding delays of means of transportation for which the transporter does not ensure according the positive regulations and international conventions. In these cases the traveler settles all additional expenses.
10. Obligations of the traveler
The traveler is obliged to:

Posses valid travel papers (personal documents). The expense in case of loosing or theft of the documents during the travel bears the traveler. Associate or representative of the organizer will help, but in terms that the program carries out undisturbed.

vaccinate and to posses the certificates and documents about vaccination for traveling in countries for which it is necessary according to the regulations of WHO. In that case the traveler encloses the medical certificate. Not possessing these documents just as and/or irregularity of personal travel documents that lead to withdrawal from the travel or impossibility of continuing the travel do not oblige the travel organizer and cancellation expenses are calculated from paragraph 8

respect customs and exchange regulations of Republic of Croatia, as well as the regulations of the countries where the traveler stays during the travel

abide the house rules in every visited facilities and to cooperate with service providers in good attentions

abide the instructions and cooperate with tourist associate and/or representative of the travel . During departure on travel to present the document about paid arrangement (voucher) to the organizers associate and/or representative, this item applies on organized group travels. In case of impiety some of these obligations, traveler is liable for made damage to the organizer
11. Luggage
Traveler has the right on free transport up to 20 kg of luggage on charter flights as well as on regular air-lines. Children up to 2 years of age haven’t got the right on costless luggage transportation. Luggage is transported on travelers’ risk, therefore the luggage insurance at the insurance company is recommended.
Travel organizer is not responsible for damaged or lost luggage as well as for luggage theft or valuable theft in the hotel (safe rent is recommended). Entry for damaged or lost luggage addresses to the transporter, airline or the reception of the accommodation facility depending on where did the damage or lose has incurred.
12. Health regulations
In some programs special regulative are quoted for the travels that includes mandatory vaccination and procurement of relevant documents. Traveler is obliged to make the mandatory vaccination as well as to have the certificates and documents about it.
13. Settlement of disputes
If the services from the program are incompletely or not quality enough executed, traveler may demand proportional reparation insomuch to deliver written reclamation.
Procedure regarding the reclamation:
-
immediately, on site, traveler reclaims the improper service to the tourist associate or representative of the organizer, and if they are not available, to the service provider. Unless the traveler does not present the reclamation on quoted means, but consumes the service, abandons the right on reparation. Traveler is obliged to cooperate with tourist associate or organizers representative and service provider in good attention to eliminate the causes of the reclamation. If the traveler on site doesn’t accept offered solution to the reclamation which conforms to the paid service, organizer will not accept additional travelers’ reclamation nor respond to it.

If the cause of the reclamation would not be eliminated, traveler with tourist associate or organizers representative or service provider sets together a written reclamation in two copies that both of them sign. Traveler holds one copy of the reclamation.

No later than 8 days on return, traveler delivers the written reclamation in the retail outlet where he paid the arrangement, and attaches the written document signed by the representative and eventual receipts for additional expenses. Organizer will receive in procedure only documented complaints which he receives in quoted time limit of 8 days

Organizer is obliged to issue written settlement on this reclamation in the time limit of 14 days after receiving reclamation in retail outlet. Organizer can postpone deadline of the reclamation settlement for data collection and verification of reclamation quotation at the service provider 14 days at most. Organizer will solve only those reclamations which cause was not possible to remove in place of stay.
14. Court jurisdiction
For all eventual disputes which are not possible to solve agreeably, court in Slunj is jurisdictional.
